How do we prosecute Donald Trump
How we prosecute Donald Trump is a matter of understanding the differences in the way we see good and evil today.
The first consideration is something that few people know about but throws light on that difference. It's a principle in law called: "Ipso facto" i. e; "After The Fact".
It would seem absurd today for anyone to think that allowing the marriage of a 14-year-old girl would be acceptable, yet Donald Trump and I know that 75 years ago in the southern states, it was actually legal. A famous rock musician named Jerry Lee Lewis married his 14-year-old cousin- legally!
So what's the point? When you call Donald Trump a pedophile, your discounting his experience in that and applying your present day thinking or even new legal strictures on something from the past. That would violate the Ipso-Facto principle of the law which is unconstitutional, and yes- it is in The Constitution.
Another charge Donald Trump has faced has to do with his business, and very few people, if any, with that large and powerful a business would Intentionally break the law. They rely instead on acountants and lawyers to tell them what's legal and they give them the go-ahead. If a mistake is made, it's not intentional and you may have heard the expression: "Intention is 9/10 of the law"; an ostensible mitigating circumstance to be considered before vilifying someone for a math error.
Now Donald Trump's overall crude demeanor is not surprising for someone around his age like myself; born and raised in the same city too, but as much as we'd like to criminalize some styles we've been horrified by ultimately, we can't seriously adjudicate such fashions' dementias.
As to his sexual dalliances, that too, occurred 60 years ago in what was understood and called The Sexual Revolution and ultimately rape, everyone agrees is a horrible thing but there's a difference between a knife being held to a woman's neck in a dark alley with the threat of being murdered and drinking too much at a party and waking the next day having had sex without even knowing it! These are not the same thing.
From my personal vantage then, Donald Trump strikes me as any normal New York person, except that he was extraordinarily foolish and completely without sense in how people would hear and understand the things he was saying.
He has to take responsibility for what happened on January 6th. because his followers took those words literally; believing they were saving their country and anyone else on trial for such a contagious collective idiocy would probably be found guilty and jailed.
